These properties inform you of the terms on which you may use https://boolerang.co.uk/, https://boolerang.com/, https://boolerang.io/, https://boolerang.co/ and any additional domain extensions (henceforth collectively referenced as the “Site”). Use of the Site includes visiting, browsing, posting job vacancies and submitting applications for opportunities listed on the Site. Additional documents referenced within this article also guide your usage of the site.

Please carefully read these terms of use (and the additional referenced documents) before you start to use the Site, as they will apply to your use of the Site.

By using of the Site and the services made available, you confirm that you accept these terms of use and that you agree to comply with them. Should you not agree to these terms, we must ask you please refrain from using the Site.

There are three sections to these terms: 1) General terms which apply to both candidates and employers, 2) Terms which apply only to candidates, and 3) Terms which apply only to employers.

Boolerang.co.uk and all associated properties are operated by Boolerang Ltd (“Boolerang” or “we”). Our Registered Company Number is: 10222221.

  1. Additional Documentation

The Terms of Use also refererences additional documentation which also apply to your use of the Site. The Boolerang Privacy Policy outlines out the terms on which we may process any personal information we collect from you, or that you provide to us. By using the Site, you consent to such processing and you confirm that all information provided by you is accurate.

  1. Use of The Site

The site and the available services comprises an online venue, enabling employers and jobseekers to connect. You may use, print and download information from the Site for purposes that reasonably assist you in participating in the outlined purpose, and for no other personal or commercial purpose. You may not otherwise copy, display, transmit or distribute any material from the Site, without seeking prior permission. You must not modify any materials retrieved from the Site in any way. Our status as the authors and publishers of such content must always be explicitly acknowledged.

  1. Accessing Boolerang.co.uk, .com, .io, or .co

You may access and use the Site anonymously as a visitor, without registration. Employers wishing to post vacancies are required to register as part of this process.

We reserve the right to suspend, remove, discontinue or amend all or any part of the Site without serving prior notice. We will not be liable to you if for any reason the Site is unavailable at any time. Whilst we endeavour to ensure that the Site and any or all of its content is available and accessible 24 hours a day, we do not give any guarantee of such. Access to the Site is permitted only on a temporary basis.

You must also ensure that all persons accessing the Site through your internet connection are aware of these Terms of Use and other applicable terms, documentation and conditions, and that they will comply with them.

  1. Intellectual Property Rights

The Site, the domain name (Boolerang.co.uk) and all Boolerang content and services provided on the Site, including but not limited to, the Site text, images and all other materials, information and documents on the Site, excluding the content provided by employers in Job Listings and other user generated content are provided to you by Boolerang Ltd.

We own or are licensed to use all intellectual property rights in the context of the Site. We grant to you a limited, personal, non-exclusive and non-transferable licence to use and to display the content solely for your use in connection with the Site and as otherwise permitted under these terms of use.

Except as expressly permitted in this documentation, you have no right to modify, edit, copy, reproduce, create derivative works of or in any way exploit any of the Boolerang content in any manner. Except for the limited rights granted within this documentation, you acknowledge that you have no right, title or interest in or to any Boolerang content.

  1. Prohibited Uses

You may not use the Site for any unlawful purpose. If you breach any Prohibited Use as set out below, you are liable to compensate us for any loss or damage that we suffer as a consequence of your actions.

You may not use the Site: in any way that breaches any applicable local, national or international law or regulation; in any way that is fraudulent, or has any fraudulent purpose or effect; to send, knowingly receive, upload, download, use or re-use any material which does not comply with our rules in the Employer Terms and Jobseeker Terms below; to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or to transmit any data or send or upload any material that contains viruses, trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

  1. Our Liability

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for: Loss of income or revenue; Loss of business; Loss of profits or contracts; Loss of anticipated savings; Loss of data; Loss of goodwill; Wasted management or office time; and For any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

If you are using this Site as a jobseeker, we will not be liable for any loss of future earnings, anticipated savings or prospects.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any content on it, or on any website linked to it.

We do not accept liability for loss of any employer content.

We assume no responsibility for the content of websites linked on the Site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

To the extent Boolerang liability in respect of these terms of use is not excluded, our total aggregate liability to you in respect of all losses arising under or in connection with these terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise is – for employers, limited to the total amount paid by the employer in the 6 months immediately preceding the act or omission giving rise to such liability, and for jobseekers, shall in no circumstances exceed £30.

  1. Conduct of Employment Agencies and Employment Business Regulations 2003

All users of Boolerang.co.uk must be aware that this Site only constitutes an online venue for employers and jobseekers to connect. Consequently, our activities mean we do not constitute an employment agency and are thus not subject to the Conduct of Employment Agencies and Employment Business Regulations 2003 (the “Regulations”).

  1. Jurisdiction and Applicable Law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms of use are governed by English law.

Candidate-Specific Terms

The following terms apply to candidates, an addition to the “General” terms specified above.

  1. Job Applications & Job Listings

In applying for jobs, the candidate should ensure that any details supplied are true, and an accurate reflection of their status and experience. Additionally, they must ensure they understand the requirements of any position they choose to apply for.

Applications are sent direct to the hiring company/persons. Candidates should be aware that any decision pertaining to the progression of a job application is solely the decision of the employer.

We do not share information in a candidate information other than with the relevant employer. Please see our Privacy Policy for more information about how we use and protect your data.

Any job listing on the site was written and provided by the respective employer We accept no responsibility or liability for the contents of the job adverts.

Job listings that contain links to other websites and resources provided by third parties are provided for your convenience and information only. If you use these links, you will be leaving the Site and do so entirely at your own risk.

Employer-Specific Terms

  1. Additional Terms – Employers

The following terms apply to employers and any persons posting job listings, in addition to those “General” terms specified above. In these contexts “employer” or “you” means any person, company, organisation or firm that orders and/or purchases Services from Boolerang Ltd – either on Boolerang.co.uk or otherwise.

“Services” means the making available of the Site for the purpose of displaying job adverts in accordance with these terms of use from time to time. No contract is formed until an employer has satisfied all stages the job posting process including, where submission of a listing, and payment.

Boolerang.co.uk is a jobs board that is geographically targeted at London, and focuses almost exclusively on technical and developer jobs. It is important you understand this before posting adverts. Additionally, when you must ensure that the contents of your job listings are accurate, honest and truthful, and that your job advert is for a genuine vacancy only, and not for other products or services, either relating to or unrelated to recruitment. You agree that job listings deemed to not meet this criteria may be rejected or removed at our discretion and without liability to you. It is your responsibility to ensure that any links to other websites contained within your job listings are actively maintained. We may remove from the Site any link or job advert which contains content or links to a website which, in our opinion, is defamatory, illegal, infringes the intellectual property rights of any person, or is objectionable or will bring us into disrepute. You will indemnify us from and against any claims or liability arising from content or links contained in your job advert.

You confirm that any job listing you submit is not illegal, including but not limited to discrimination of any nature (including but not limited to sex, race or disability). Employers need to create accounts to post adverts on Boolerang.co.uk. Depending on where you register, will either be required to choose a username and password, or a username, and subsequently choose a password using a link provided to you via email. We reserve the right to disable or delete an employer account at any time, without liability to you. Requests for a refund of fees paid by employers will be considered on a case-by-case basis, and you agree and understand that any refund is entirely at our discretion.

Should you, in our opinion, breach any of the terms set out within this document, we reserve the right to (without liability) remove your job listings, delete your account, or withdraw your permission to use the Site. You agree that following deletion of your account, or withdrawal of your permission to use the Site and the services contained within, you must receive written permission from us to resume your use of the Site before doing so.

  1. Payment for Services

Boolerang Ltd is not currently VAT Registered, so VAT will not be included in any payment made. Payment can be paid either: via Stripe or Paypal – and by proceeding with this method, you agree to any applicable terms; or via Invoice to Boolerang Ltd following the issuing of an invoice. All invoices are payable within 14 days from invoice date.

  1. Listing Prices

The prices are made available on the Site and may be amended without notice. A job posted the Site will remain live for a minimum of 45 days or such shorter time as we agree with you. An employer may request the removal of a job advert from the Site before the end of the period specified at the time of purchase, but shall not be entitled to any refund of fees. Prices are guaranteed for the period stated at the time of purchase. Job adverts are passed to Boolerang Ltd for approval. Publishing your listing is entirely at our discretion, and we may decline to publish listings where they are deemed to be in breach of our terms, or do not meet the requirements set out in Item 13. Once payment has been received, You will be notified by email when your job advert has gone live on the Site.

  1. Licensing of Properties

You agree that we may use your name, trademarks and logos (“IP Rights”) for the purposes of providing the Services. Additionally you agree that we may mention you as a reference customer in marketing materials (such as, but not limited to websites and newsletters), that we may use your IP Rights in this context and may present examples of the services provided to and the materials published on your behalf.

  1. Applications for Job Listings

You will not share, distribute, modify or otherwise supply any personal information pertaining to candidates received from us. Additionally, you will comply with all elements referenced within the Data Protection Act 1998.

You will only use CVs and person identifiable jobseeker information submitted via the Site for the purpose of finding employees to fill current vacancy(ies).

We do not guarantee any response to your advert or that responses will be from individuals suitable for the job advertised.

We understand employers cannot respond to every application, but where communication is made, you will act professionally and refrain from any actions which may bring Boolerang into disrepute, and will be liable for any claim brought against Boolerang as a result of your actions in these contexts.

Additional Information

Change of Terms

We reserve the right to revise these terms at any time. Amendments to the terms of use will be published with an updated effective date. Following such amendments, should you continue to use the Site, you are deemed to have consented to the revised terms.
